Hopefully, things are about to change. Regarded as the first resolution of a sexual orientation discrimination suit under Title VII, EEOC v. Pallet Companies, d/b/a IFCO, is bound to put employers on notice that they cannot get away with discrimination against their LGBT employees. According to the suit, a lesbian employee was subjected to incessant harassment at the hands of her supervisor, who could not come to grips with the employees sexual preference and gender identity. To show his displeasure, the supervisor would often say, “I want to turn you back into a woman,” and “You would look good in a dress.” Feeling uncomfortable with these comments and harassed, the employee complained to his superiors, who she thought would investigate her complaint and put a stop to the harassment. Sadly, the higher level bosses at IFCO decided to side with the supervisor, and fired the employee in retaliation for her complaint. Feeling wronged, the lesbian employee filed a wrongful termination complaint.
And, as would be expected, IFCO was initially unwilling to admit its fault or engage in a pre-litigation settlement. But as is typical, as litigation wore on and the employer faced the possibility of trying to explain its discrimination and retaliation to jurors, who are becoming less and less tolerant of discrimination against LGBT/LGBTQ employees, finally caved and settled. As part of the employment discrimination settlement, IFCO will pay the wronged employee $202,200.00 and prevent future sex discrimination and retaliation at its workplace.
