Yesterday, our employment discrimination lawyers blogged about racist managers that called their African American employees “monkeys” and “slaves.” Obviously, such language is extremely offensive. Many of our regular readers responded by asking if this type of language is common in the workplace. While hopefully not common, it does happen a lot. In fact, it is frequently worse. Let’s address one of those examples.

A recent $1.2 million out-of-court settlement was recently approved by a federal judge in Casper, Wyoming involving a well servicing company where racist slang terms were used regularly in the workplace. Dart Energy Corp., Beckman Production Services, Inc. and J&R Well Service, LLC were sued by a group of employees that claimed they were discriminated against because of their race and retaliated against for reporting the racial discrimination.

In their suit, the employees claimed that a supervisor regularly used terms such as “wetback” and “beaner” to refer to Hispanic employees, “wagon burner” to refer to Native American employees, and the word “nigger” to refer to black employees. The supervisor also used less common slangs such as referring to shovels as “Mexican backhoes” and also told employees that “Custer should have killed all the Indians.”

The lawsuit also focused on racist slangs used on oil rigs operated by the Defendants. Minority employees on the rig heard the term “nigger rigging” and “nigger a pipe down” on a regular basis. Employees on the rig also heard demeaning and prejudicial remarks regarding green cards and threats of deportation. When the employees would complain about these racist slangs, their complaints were either ignored completely, or the complaining employees were demoted or fired.

It is a common defense to the use of these types of slangs certain types of workplaces are historically often a very loose and profanity-laden place to be employed. However, as this million dollar plus settlement shows, there is no excuse to using inflammatory and racist slangs in the workplace. Even if the slangs are not directed at minority employees, use of these slangs in the presence of employees in a protected class is absolutely actionable and should be reported immediately. It is no excuse that “boys will be boys” or “that is just our culture” when horrible terms that include racist slurs are used openly.
